By purchasing and downloading a layout from LayoutDiva.com you agree to the following License Agreement:

The layouts may be used for your own and/or your customers' projects or print jobs, but you may not put them on a diskette, CD, project or any other medium and offer them for redistribution or resale. This means that if you are a web developer, consultant, and/or graphic designer you are free to use the layouts in the design of your customers' projects. However, the layouts may not be resold in any sort of collection, such as passing our layouts over to third parties in CD's and diskettes, or letting others download our layouts from your projects. In the event of such a practice. By conducting such a practice, you automatically waive any legal claims against LayoutDiva.com, DivaDesignWorld and Monique Danielle Creative, LLC. If you do not abide by the terms of this agreement as described above, LayoutDiva.com will pursue legal action to the highest extent.

You are only granted a one-time-use license for each layout. (Note: if you are planning to use our layouts to design a project for your commercial client(s), it is advisable to inform your client(s) in advance that you will be using pre-made layouts for their projects in order to avoid possible legal disputes with your client(s).

The layouts are provided "as is" without warranty of any kind, either expressed or implied. You are responsible for adding or editing your project's content (e.g. pictures, photos, and text) to the layout itself. Technical support will be limited to problems such as the alignment of graphics and similar difficulties you experience. We suggest that you contact your local web developer(s) for service and assistance.

All images, graphics, and photos, are purchased and licensed from third-party stock photo agencies. You may not use the images, photos, and graphics anywhere else other than the layouts you have purchased.

You understand that LayoutDiva.com is not responsible for the content, quality or merchantability of any information, product or service offered herein and the user must assume full responsibility to evaluate independently the accuracy, completeness, quality and usefulness of any information or other content. LayoutDiva.com hereby expressly disclaims any and all warranties, expressed and implied, including but not limited to any warranties of accuracy, reliability, merchantability or fitness for a particular purpose by any vendor, customer, associate offering information, products, or any services linked to the LayoutDiva.com project. The user agrees that LayoutDiva.com is not responsible, and shall have no liability to such user, with respect to any information, product or service offered by others who are linked to the LayoutDiva.com project. LayoutDiva.com shall not be liable for any damages allegedly sustained arising from use of the information, products, and services.

In no event shall LayoutDiva.com be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages, or other losses arising out of the use of or inability to use the layouts from LayoutDiva.com.

LayoutDiva is committed to protecting your privacy. LayoutDiva will never sell personally identifiable information about you or your business to any third party without first receiving your permission.

In order to protect you, LayoutDiva currently uses PayPal as our payment collection source. PayPal uses Secure Sockets Layer (SSL) software to protect your data and secure you and your customers' transactions. SSL encrypts all your personal information, including name, billing address, credit card number, etc, as it is transmitted over the Internet.

There will be no refunds or exchanges after you have made a layout purchase. All sales are final.

LayoutDiva.com's layouts are created using Dreamweaver. For optimal results, please edit with the same software.

LayoutDiva may at any time, modify this agreement without prior notice. An agreement will always be posted on our site for members to review.

If agreement terminates due to any illegal activity, all rights granted to you under this agreement shall terminate immediately. If LayoutDiva terminates this agreement or suspends your access to LayoutDiva's Services and/or Products. LayoutDiva reserves the right to delete any data files associated with your use of the LayoutDiva Service or Products upon termination of this Agreement.

CREDIT CARD FRAUD IS A FEDERAL CRIME AND A FELONY PUNISHABLE BY HEAVY FINES AND JAIL TIME. FRAUDULENT BEHAVIOR WILL BE PROSECUTED TO THE FULLEST EXTENT OF THE LAW. LayoutDiva.COM WILL REPORT ANY FRAUDLENT TRANSACTIONS TO INTERNATIONAL INTERNET FRAUD AGENCIES AND WILL PROSECUTE WHENEVER AND WHEREVER POSSIBLE TO THE FULLEST EXTENT OF THE LAW.
